Actress and activist Rosie O’Donnell has truly gone off the deep end since President Donald Trump’s election. It’s not a fair fight, but watching conservative wunderkind Ben Shapiro tear up Rosie’s political arguments on Twitter is one of the more amusing activities of 2017.

While this week’s sniping between the two was thoroughly entertaining, at the core of the spat is an actual crime. In an effort to stop the tax reform vote, Rosie O’Donnell offered to pay Sen. Jeff Flake (R-AZ) and Sen. Susan Collins (R-ME) two million dollars each if they’d vote no – and she made this bribery offer on Twitter.

A Federal Crime in Public

Rosie, in her profane barely-literate style, was ranting about the tax reform bill that was up for a vote in the Senate.

In an effort to stop the reform from going through, Rosie engaged in what she thought was a mic-drop moment, tweeting an offer of two million dollars each to two Republican senators if they would only vote no:

so how about this
i promise to give
2 million dollars to senator susan collins
and 2 million to senator jeff flake

if they vote NO

DM me susan
DM me jeff

no shit
2 million

There’s just one problem with Rosie’s public offer; it’s called attempting to bribe a public official, and it’s a violation of federal law – 18 U.S. Code Section 201, to be exact.

The statute reads:

Whoever directly or indirectly, corruptly gives, offers or promises anything of value to any public official or person who has been selected to be a public official, or offers or promises any public official or any person who has been selected to be a public official to give anything of value to any other person or entity, with intent to influence any official act…

The crime carries a punishment of up to three times the offered amount, as well as up to 15 years in prison.

That apparently doesn’t faze Rosie – she doubled down on her tweet a bit later, telling Sen. Collins to “call if you want to negotiate” the “2 million dollars cash” offer.

Shapiro Chimes In

While the Twitter-verse reeled from Rosie’s blatant public crime, Ben Shapiro jumped on the opportunity.

“If Trump orders [Attorney General Jeff] Sessions to investigate Rosie, he will be carved into Rushmore by Friday,” Shapiro tweeted much to Twitter’s delight.

Rosie responded with a crude profanity, and Shapiro got another freebie.

“You’re already a felon, Rosie,” Shapiro pointed out, following his tweet with the hashtag #MeToo. “Don’t be a homophobic sexual harasser too” he added.

The Trump administration has not commented on Rosie’s public bribery attempt or whether it plans to investigate her as of Wednesday morning.
